Understanding the Thresholds

< 6 months

Safe

Trips under 6 months generally do not affect continuous residence. No special action needed.

6-12 months

Rebuttable Presumption

USCIS presumes continuous residence was broken, but you can overcome this by showing you maintained US ties: home, job, family, bank accounts, tax filings, and intention to return.

> 12 months

Presumed Broken

A trip over 12 months almost certainly breaks continuous residence. The 5-year clock restarts from your return date. Exceptions exist but are very limited (e.g., N-470 approved absence). Consult an immigration attorney.

Important Notes

Continuous residence is separate from the physical presence requirement. You can meet one without meeting the other. Make sure to check both before filing.
