The Physical Presence Requirement

For the standard 5-year path to citizenship, you must have been physically present in the United States for at least 30 months (913 days) out of the 5 years immediately preceding your N-400 filing date.

For the 3-year path (married to a US citizen), the requirement is 18 months (548 days) out of the preceding 3 years.

"Physical presence" means you were actually in the United States. Days spent outside the US count against you, regardless of the reason for travel.

How to Calculate Your Physical Presence

The calculation is straightforward in concept:

  1. Determine your statutory period (5 years or 3 years before your filing date)
  2. List every trip outside the US during that period
  3. Add up the total days you were outside the US
  4. Subtract that total from the total days in the statutory period
  5. The result is your physical presence in days

Common Pitfalls

Counting Departure and Return Days

The day you depart the US counts as a day outside the US. The day you return counts as a day in the US. So if you left on January 1 and returned on January 10, that's 9 days outside the US (Jan 1 through Jan 9) and 1 day in the US (Jan 10).

Forgetting Short Trips

Even a quick day trip to Canada or Mexico counts. Those days add up, especially for people living near the border who cross frequently.

Confusing Physical Presence with Continuous Residence

What If You Don't Qualify Yet?
